L’informativa è resa esclusivamente per il presente sito web (“Sito”), pertanto K Project non si assume alcuna responsabilità in merito agli altri siti web eventualmente consultati tramite collegamenti ipertestuali presenti sul Sito.

Gli utenti, utilizzando il presente Sito, accettano la presente informativa e sono, pertanto, invitati a prenderne visione prima di fornire informazioni personali di qualsiasi genere.

1. Titolare del trattamento

K Project S.r.l. è il titolare del trattamento dei dati personali raccolti attraverso il Sito. 

Per determinate operazioni di trattamento, K Project si avvale di dipendenti, agenti o collaboratori, i quali sono incaricati a svolgere operazioni di trattamento sotto l’autorità del titolare, nonché di società partner o studi professionali che prestano attività di assistenza e consulenza in materia contabile, amministrativa, legale, tributaria e finanziaria dislocati sul territorio dell’Unione Europea, i quali sono debitamente nominati responsabili del trattamento ai sensi dell’art. 28 del GDPR.

L’elenco aggiornato dei responsabili del trattamento, nonché dei soggetti che svolgono operazioni di trattamento sotto l’autorità del titolare, è custodito presso la sede del titolare medesimo. L’elenco aggiornato dei responsabili e degli incaricati al trattamento è custodito presso la sede del titolare del trattamento.

2. Categorie di dati personali 

K Project tratterà suoi dati personali raccolti in occasione della conclusione del contratto e nel corso del rapporto contrattuale (“Dati“). 

A titolo esemplificativo, il titolare acquisirà le seguenti tipologie di dati personali: 

1. Dati anagrafici, quali nome e cognome, luogo e data di nascita, indirizzo di residenza;
2. Dati di contatto, quali l’indirizzo di spedizione, il numero di telefono e l’indirizzo di posta elettronica;
3. Dati di navigazione, quali indirizzo IP, orario di accesso al sito e/o di registrazione alla piattaforma, eventuale referer di iscrizione, metodi di accesso al server, codice numerico indicante lo stato della risposta data dal server (buon fine, errore, ecc.);

Attraverso il Sito, il titolare non acquisirà dati di natura sensibile o comunque appartenenti alle categorie particolari di cui all’art. 9 del GDPR o dati relativi a condanne penali o reati.

I suoi Dati saranno trattati da K Project esclusivamente per le finalità e nei limiti indicati al paragrafo successivo. Tutte le informazioni inviate sul Sito sono salvaguardate e trasmesse solo attraverso protocollo crittografato SSL.

3. Finalità e base giuridica del trattamento

K Project utilizzerà i suoi Dati per le seguenti finalità:

Per l’esecuzione del contratto

• I Dati indicati al paragrafo 2, nn. 1-3, saranno trattati da K Project per consentirle la registrazione al Sito e la fruizione dei servizi ad esso specificatamente connessi. A titolo esemplificativo, i suoi Dati saranno trattati per manutenzione ed assistenza tecnica, nonché al fine di migliorare la qualità dei servizi offerti. I Dati saranno quindi trattati per l’esecuzione del contratto in essere con il Titolare. Il conferimento dei Dati è necessario per consentire l’instaurazione e la gestione del rapporto contrattuale; in difetto non ci sarà possibile dare esecuzione al contratto ed erogarle il servizio richiesto. Nel caso in cui fornisse a K Project dati di soggetti terzi per l’invio di una Gift Card (buono regalo elettronico), K Project invierà a questi soggetti terzi un link all’informativa privacy nella prima comunicazione utile. La informiamo che K Project non tratta dati personali relativi ai minori d’età. Accedendo al Sito ed utilizzando i relativi servizi dichiara di avere compiuto la maggiore età.

Per rispondere alle richieste di informazioni

• I Dati indicati al paragrafo 2, nn. 1-2, saranno trattati da K Project per evadere la sua richiesta. Ove a tal fine si renda necessario il ricorso ad una società terza avente l’esclusiva commerciale di determinati prodotti Kyminasi o per la vendita a determinate fasce di mercato, questo sarà indicato chiaramente nel modulo e verrà richiesto il suo esplicito consenso all’inoltro della richiesta a detta società. In mancanza di tale consenso, non sarà possibile evadere la richiesta di informazioni da parte di K Project.

Un esempio è quello della società Harvest Harmonics (Organic Earth Tech LLC. – 611 Druid Rd East – Suite 201 , Clearwater, FL 33756), esclusivista internazionale per la commercializzazione dei dispositivi Kyminasi Plants verso agricoltori e professionisti nel campo delle coltivazioni.

Per finalità di marketing (solamente se il consenso viene fornito esplicitamente)

• Vendita diretta. Previo suo specifico consenso, K Project potrà trattare i suoi Dati per l’invio di materiale pubblicitario o di comunicazioni commerciali relative ad eventuali promozioni oppure per ricerche di mercato. L’invio di tali comunicazioni potrà avvenire tramite l’utilizzo di sistemi automatizzati (es. e-mail, SMS, notifiche push) e di sistemi tradizionali (es, posta cartacea). Per tale finalità di trattamento saranno utilizzati i Dati di cui al paragrafo 2, nn. 1 e 2. Il consenso prestato è revocabile in ogni momento, anche con riferimento ai soli sistemi di contatto automatizzati, scrivendo a [email protected].
• Newsletter. I Dati indicati al paragrafo 2, n. 2, forniti in sede di iscrizione alla newsletter verranno utilizzati da K Project al solo fine erogare il servizio di newsletter richiesto. I Dati saranno quindi trattati per l’erogazione del servizio richiesto al titolare. Lei potrà in qualsiasi momento chiedere di cancellare la Sua iscrizione alla newsletter seguendo le istruzioni di volta in volta indicate in ogni comunicazione effettuata per le finalità di cui al presente punto. 

Per finalità di profilazione

• K Project potrà trattare i Suoi Dati per comprendere le Sue abitudini e preferenze d’acquisto in relazione ai prodotti e servizi offerti tramite il Sito al fine di offrirle prodotti e servizi in linea con il Suo profilo. Per il perseguimento di tale finalità, K Project potrà trattare i Dati di cui al paragrafo 2, nn. 1-2. Tali Dati saranno trattati da K Project sulla base del proprio legittimo interesse all’ottimizzazione delle proprie procedure d’acquisto, attraverso l’offerta di prodotti e servizi più funzionali ed utili alle specifiche esigenze dei clienti. Il legittimo interesse di K Project è stato opportunamente bilanciato con i Suoi interessi e aspettative mediante la previsione di misure tecniche e giuridiche al fine di ridurre al minimo l’impatto della profilazione svolta da K Project sulla Sua sfera giuridica.
  Le ricordiamo che, ai sensi dell’art. 21 del GDPR, Lei potrà opporsi in qualsiasi momento a tale trattamento scrivendo a [email protected]

4. Periodo di conservazione dei dati e durata dei trattamenti

I Suoi Dati personali saranno conservati su server cloud gestiti da Infomaniak (Svizzera) conformi ai più alti livelli di sicurezza attualmente in vigore.

I suoi Dati saranno oggetto di conservazione per tutta la durata del rapporto contrattuale con K Project. In seguito alla cessazione del rapporto, i Dati saranno conservati per un periodo di 10 anni esclusivamente per esigenze di tutela dei diritti del titolare e per l’adempimento di obblighi di legge. Con riferimento ai trattamenti per fini di marketing indicati al paragrafo 2, lett. b), la informiamo che i Dati saranno trattati per tutta la durata del contratto salvo eventuale revoca del consenso da Lei prestato o esercizio del Suo diritto di opposizione al trattamento.

Con riferimento ai dati trattati per finalità di profilazione, La informiamo che i Dati saranno trattati per un periodo massimo di 12 mesi o per il diverso periodo che dovesse essere disposto dalla legge o da provvedimenti dell’Autorità Garante, salvo eventuale esercizio del Suo diritto di opposizione al trattamento. Decorso tale periodo o in caso di opposizione, i dati saranno conservati se necessari per perseguire altre finalità o saranno definitivamente cancellati.

5. Difesa in giudizio

I Suoi Dati possono essere utilizzati per la difesa da parte di K Project in giudizio o nelle fasi propedeutiche alla sua eventuale instaurazione.

6. Cookie

I cookies sono dei semplici file di testo che vengono memorizzati sul computer del visitatore e permettono di registrare alcuni parametri utili al nostro sistema per adattare il Sito alle esigenze dell’utente e favorirne l’utilizzo.

Non è indispensabile accettare i cookies per navigare nel Sito, tuttavia sono necessari per usufruire di alcune delle funzioni principali, come ad esempio aggiungere articoli al Carrello o accedere all’Area Clienti. 8. Diritti degli utenti

La informiamo che, in conformità alla vigente disciplina, ha i seguenti diritti:

• per i dati oggetto di trattamento con sistemi automatizzati, chiedere il trasferimento ad altro titolare;
• chiedere e ottenere la modifica e/o correzione dei suoi dati personali se ritiene che siano inaccurati o incompleti;
• chiedere e ottenere la cancellazione – e/o la limitazione del trattamento dei suoi dati personali qualora si tratti di dati o informazioni non necessari – o non più necessari – per le finalità che precedono, quindi decorso il periodo di conservazione indicato in precedenza 

Tali richieste potranno essere trasmesse al titolare scrivendo a [email protected] o tramite raccomandata A/R indirizzata alla sede legale di K Project più sopra indicata.

Se lo desidera può richiedere di ricevere i dati personali in possesso di K Project che la riguardano in un formato leggibile da dispositivi elettronici e, laddove tecnicamente possibile, trasferire i suoi dati direttamente ad altro soggetto espressamente indicato (portabilità).

La informiamo inoltre che ai sensi della disciplina vigente può proporre eventuali reclami riguardanti i trattamenti di suoi dati personali al Garante per la protezione dei dati personali.

9. Promozioni: adesione e perdita del diritto di fruirne

In aggiunta alla creazione del Kyminasi Club di cui al punto 3, K Project si riserva di effettuare delle campagne promozionali, con l’obiettivo di acquisire nuova clientela o fidelizzare, premiare la clientela esistente. Qualora le condizioni per fruire della promozione siano strettamente correlate all’avvenuta autorizzazione da parte del cliente all’utilizzo dei propri dati di contatto per ricevere comunicazioni commerciali, di marketing, informative da parte di Kyminasi, la richiesta di cancellazione dalla suddetta lista comporterà automaticamente la rinuncia a tali promozioni. Resta salvo il diritto dell’utente di effettuare una nuova iscrizione in qualsiasi momento lo desideri, per riacquisire il diritto di godere della promozione.

10. Modifiche

K Project si riserva la facoltà di modificare o semplicemente aggiornare il contenuto della presente Informativa Privacy, in tutto o in parte.

1. Data Controller

K Project S.r.l. is the data controller of the personal data collected through the Site.

For certain processing operations, K Project uses employees, agents or collaborators, who are appointed to carry out processing operations under the authority of the data controller, as well as partner companies or professional firms that provide assistance and consultancy in accounting, administrative, legal, tax and financial matters located in the territory of the European Union, who are duly appointed as data processors pursuant to article 28 of the GDPR.

The updated list of data processors, as well as of persons performing processing operations under the authority of the data controller, is kept at the data controller’s registered office. The updated list of data processors and persons in charge of the processing is kept at the data controller’s head office.

2. Categories of personal data

K Project will process your personal data collected during the conclusion of the contract and in the course of the contractual relationship (“Data”).

By way of example, the controller will collect the following types of personal data:

Personal data, such as name and surname, place and date of birth, residential address;
Contact data, such as shipping address, telephone number and e-mail address;
Navigation data, such as IP address, time of access to the site and/or registration to the platform, possible registration referer, server access methods, numeric code indicating the status of the response given by the server (successful, error, etc.);
Through the Site, the owner will not acquire data of a sensitive nature or in any case belonging to the special categories referred to in Article 9 of the GDPR or data relating to criminal convictions or offences.

Your Data will be processed by K Project exclusively for the purposes and within the limits indicated in the following paragraph. All information sent on the Site is safeguarded and transmitted only through SSL encrypted protocol.

3. Purpose and legal basis of the processing

K Project will use your Data for the following purposes:

For the execution of the contract

The Data indicated in paragraph 2, nos. 1-3, will be processed by K Project in order to allow you to register on the Site and use the services specifically related to it. By way of example, your Data will be processed for maintenance and technical assistance, as well as to improve the quality of the services offered. The Data will therefore be processed for the execution of the contract in place with the Owner. The conferment of the Data is necessary to allow the establishment and management of the contractual relationship; otherwise, it will not be possible for us to execute the contract and provide the requested service. In the event that you provide K Project with data from third parties for the purpose of sending a Gift Card (electronic gift voucher), K Project will send these third parties a link to the privacy policy in the first useful communication. Please note that K Project does not process personal data of minors. By accessing the Site and using its services, you represent that you are of legal age.
To respond to requests for information

The data indicated in paragraph 2, nos. 1-2, will be processed by K Project in order to deal with your request. If it is necessary to use a third party company for this purpose which has exclusive commercial rights to certain Kyminasi products or to sell them to certain market segments, this will be clearly stated on the form and your explicit consent will be requested to forward your request to that company. Without this consent, we will not be able to process your request for information from K Project.
An example is the company Harvest Harmonics (Organic Earth Tech LLC. – 611 Druid Rd East – Suite 201 , Clearwater, FL 33756), the international exclusive distributor of Kyminasi Plants devices to farmers and crop professionals.

For marketing purposes (only if consent is given explicitly)

• Direct sale. Subject to your specific consent, K Project may process your data to send you advertising material or commercial communications relating to promotions or market research. These communications may be sent through the use of automated systems (e.g. e-mail, SMS, push notifications) and traditional systems (e.g. paper mail). The Data referred to in paragraph 2, nos. 1 and 2 will be used for this purpose. The consent given is revocable at any time, even with reference to automated contact systems only, by writing to [email protected].
• Newsletter. The Data indicated in paragraph 2, no. 2, provided at the time of subscription to the newsletter will be used by K Project for the sole purpose of providing the requested newsletter service. The Data will therefore be processed for the provision of the requested service to the owner. You may at any time request to cancel your subscription to the newsletter by following the instructions from time to time indicated in each communication made for the purposes referred to in this point.

For profiling purposes

K Project may process your data to understand your purchasing habits and preferences in relation to the products and services offered through the Site in order to offer you products and services in line with your profile. For the pursuit of this purpose, K Project may process the Data referred to in paragraph 2, nos. 1-2. Such Data will be processed by K Project on the basis of its legitimate interest in optimising its purchasing procedures, through the offer of products and services that are more functional and useful to the specific needs of its customers. K Project’s legitimate interest has been appropriately balanced with your interests and expectations through the provision of technical and legal measures to minimize the impact of profiling carried out by K Project on your legal sphere.
We remind you that, pursuant to Article 21 of the GDPR, you may object to such processing at any time by writing to [email protected].

 

4. Period of data retention and duration of processing

Your Personal Data will be stored on cloud servers operated by Infomaniak (Switzerland) complying with the highest levels of security currently in force.

Your Data will be stored for the duration of the contractual relationship with K Project. After the termination of the relationship, the Data will be stored for a period of 10 years exclusively for the purpose of protecting the rights of the owner and for the fulfilment of legal obligations. With reference to the processing for marketing purposes indicated in paragraph 2, letter b), we inform you that the Data will be processed for the entire duration of the contract unless you withdraw your consent or exercise your right to object to the processing.

With reference to the data processed for profiling purposes, we inform you that the Data shall be processed for a maximum period of 12 months or for the different period that may be provided for by law or by measures of the Guarantor Authority, unless you exercise your right to object to the processing. After this period or in case of opposition, the data will be kept if necessary to pursue other purposes or will be permanently deleted.

5. Legal defence

Your data may be used for the defence of K Project in legal proceedings or in the preparatory phases of such proceedings.

6. Cookies

Cookies are simple text files that are stored on the visitor’s computer and allow us to record some useful parameters for our system to adapt the Site to the user’s needs and facilitate its use.

It is not necessary to accept cookies in order to navigate on the Site, but they are necessary in order to use some of the main functions, such as adding items to the Shopping Cart or accessing the Customer Area. Moreover, cookies can be useful to improve security in order to prevent fraudulent activities. In no way are cookies used to transmit information of a personal nature.

The user may refuse or revoke authorisation at any time by selecting the corresponding parameters in the specific options of the browser in use.

Pages or articles on the site may contain videos embedded by Vimeo or Youtube. Content embedded by other sites behaves as if the visitor has visited that other site.

These websites may collect data about you, use cookies, embed additional third party tracking and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and access that website.

8. Users’ rights

We inform you that, in accordance with current regulations, you have the following rights

to request and obtain information about the existence of your data in the availability of K Project and access to such data;
for data subject to processing with automated systems, request the transfer to another owner
to request and obtain the modification and/or correction of your personal data if you believe that they are inaccurate or incomplete
to request and obtain the deletion – and/or the limitation of the processing – of your personal data if such data or information are not necessary – or no longer necessary – for the purposes set out above, and therefore after the conservation period indicated above has expired
Such requests may be sent to the data controller by writing to [email protected] or by registered letter with return receipt addressed to the registered office of K Project indicated above.

If you wish, you can request to receive the personal data held by K Project concerning you in an electronically readable format and, where technically possible, to transfer your data directly to another party expressly indicated (portability).

We would also like to inform you that, in accordance with the regulations in force, you may lodge a complaint about the processing of your personal data with the Data Protection Authority.

9. Promotions: membership and loss of the right to benefit from them

In addition to the creation of the Kyminasi Club mentioned in point 3, K Project reserves the right to carry out promotional campaigns, with the aim of acquiring new clients or retaining and rewarding existing clients. If the conditions for benefiting from the promotion are strictly related to the customer’s authorisation to use his or her contact details to receive commercial, marketing and information communications from Kyminasi, the request to be removed from the aforementioned list will automatically result in the renunciation of such promotions. This is without prejudice to your right to re-register at any time you wish in order to regain the right to enjoy the promotion.

10. Changes

K Project reserves the right to change or simply update the content of this Privacy Policy, in whole or in part.

K Project will inform you of any such changes as soon as they are made.
